Terms of Service

These terms apply when you engage Profiting AI (ABN 48 446 556 275, "we", "us", "our") to build a website or provide SEO services. They sit alongside any written quote or scope of work, which takes precedence if there's a conflict.

1. What we do

We design and build websites for small businesses and provide local SEO services. Our standard package is a $500 one-off build, with an optional $20/month for domain registration, hosting and maintenance. The scope of every build is confirmed in writing before work starts.

2. Pricing and payment

• The $500 build fee is payable as 50% deposit on engagement and 50% on launch, unless agreed otherwise in writing.
• The optional $20/month hosting/maintenance fee is billed monthly and can be cancelled at any time with 30 days' notice.
• All prices are in Australian dollars. We are not currently registered for GST.
• Out-of-scope work (e.g. additional pages, complex integrations, content writing beyond what's quoted) is charged separately and agreed in writing first.

3. What you provide

To get your site built in 2–3 weeks, we need timely input from you — business details, content (logos, photos, copy or rough notes we can polish), and reasonable feedback on drafts. If we're waiting on you, timelines extend.

4. Revisions

Each build includes two rounds of revisions on design and copy. Additional rounds are billed at an hourly rate agreed before work begins.

5. Intellectual property and ownership

• Once final payment is received, you own the final website — code, copy, design, and domain name (if registered through us).
• We may showcase the work in our portfolio with a link back to your site, unless you ask us not to.
• Content you provide (logos, photos, text) remains your property. By giving it to us you confirm you have the right to use it.
• Any third-party plugins, fonts or stock imagery used are subject to their own licences.

6. SEO — what we can and can't promise

SEO results depend on factors outside any provider's control — Google's algorithms, competitor activity, the age and trust of your domain, and how often you update content. We commit to applying current best practices (technical SEO, keyword strategy, on-page optimisation, schema, Google Business Profile setup). We do not and cannot guarantee any specific ranking, position, traffic figure or sales outcome. Anyone who tells you otherwise is lying to you.

7. Hosting and maintenance (optional $20/month)

If you take the optional hosting and maintenance plan, we cover domain renewal, hosting fees, SSL, small content updates (text, image swaps, new opening hours, etc.), and ongoing technical health checks. Larger changes — new pages, redesigns, e-commerce additions — are billed separately. If you cancel, we'll transfer the domain and any account access to you at no extra charge.

8. Cancellation and refunds

• If you cancel before work starts, the deposit is fully refundable.
• If you cancel after work has started, we'll refund any portion of the deposit not yet earned, based on hours worked.
• No refund is available once a site has been launched on your domain.

9. Liability

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. To the extent permitted by law, our liability for any claim related to our services is capped at the amount you've paid us in the 12 months before the claim. We are not liable for indirect or consequential loss (lost profits, missed opportunities, etc.).

You're responsible for backing up content once handed over, for keeping account passwords secure, and for the accuracy of any information you publish.

10. Disputes

If something goes wrong, contact us first — most problems are sorted with a phone call. If we can't resolve it directly, we'll work in good faith toward a fair outcome before either party escalates. These terms are governed by the laws of Victoria, Australia.

11. Changes to these terms

We may update these terms occasionally. Existing engagements run under the terms in place when work was agreed; updates only apply to new engagements.
